Terms and conditions Event Safety Service

Below are the terms and conditions of Event Safety Service (Chamber of Commerce number 91608848). They apply to all our offers, quotes, assignments and agreements, unless agreed otherwise in writing.

1. Toepasselijkheid

These terms apply to every offer and agreement between Event Safety Service and the client. Deviations only apply if we have confirmed them in writing. We expressly reject any other (purchasing) terms.

2. Offertes en aanbiedingen

All our quotes and price indications are without obligation unless stated otherwise. They are based on the information known at the time of the request. Images, measurements and descriptions are approximate and not binding.

3. Formation of the agreement

An agreement is formed as soon as we confirm your assignment in writing or begin performing it. We may have the work carried out wholly or partly by third parties.

4. Uitvoering en meerwerk

The client provides a safe, easily accessible working location and the necessary facilities and permits. If we unexpectedly encounter an unsafe situation, we may suspend the work. Additional work is discussed in advance and may be charged at our usual rates.

5. Levertijden

Any periods stated are indicative and never a strict deadline. If we expect a significant overrun, we will contact you in good time.

6. Prijzen

Prices exclude VAT and any government levies unless stated otherwise. If our cost prices rise, we may adjust the price accordingly. Travel costs may be charged separately.

7. Betaling

Invoices must be paid within the period stated on the invoice. In the event of late payment you are in default by operation of law and we may charge interest and reasonable collection costs.

8. Klachten

Complaints about work delivered or invoices should be reported as soon as possible and in writing, with a clear description. We resolve a justified complaint through correction or a suitable solution.

9. Annulering en opschorting

If the client does not meet the agreements, we may suspend our work or terminate the agreement. Cancellation charges may apply if the client cancels.

10. Aansprakelijkheid

Our liability is limited to the invoice amount of the relevant assignment, except in cases of intent or gross negligence. We are not liable for indirect damage. The client indemnifies us against third-party claims.

11. Eigendomsvoorbehoud

Materials supplied remain our property until everything has been paid in full.

12. Overmacht

In the event of force majeure we may suspend performance or terminate the agreement in whole or in part, without owing any compensation.

13. Intellectueel eigendom

All designs, plans and documents we produce remain our property and may not be used or copied without our written consent.

14. Toepasselijk recht

Dutch law applies to all our agreements. Disputes are submitted to the competent court in the district where we are established.
